Terms of Service

These Terms of Service ("Terms") govern your use of chat.benzos.uk and the Benzos AI chatbot platform, including the chat widget, the dashboard, and integrations with channels such as Facebook Messenger (the "Service"), operated by Benzos — Benzo Labs ("Benzos", "we", "us"). These Terms apply both to: • Business customers — companies that register for an account and deploy chatbots ("Customer"); and • End users — individuals who chat with a chatbot powered by Benzos ("End User"). Where an End User interacts with a chatbot operated by a Customer, the Customer is the controller of that conversation and is responsible for its own relationship with the End User. Benzos acts as processor for that conversation. By using the Service, you confirm you have read and accept these Terms; if you do not agree, do not use the Service.

Benzos provides a platform to create, train, configure, and deploy AI chatbots, including knowledge-base/RAG training, a website chat widget, Facebook Messenger connection, conversation history, human handoff to live agents, and analytics. The Service relies on third-party AI model providers. AI-generated answers are probabilistic and may be incomplete or inaccurate; they are not professional, legal, medical, or financial advice. Benzos does not guarantee that any AI answer is accurate, complete, or fit for a particular purpose. We may modify, suspend, or discontinue features of the Service with reasonable notice. Free, trial, or beta features may be changed or withdrawn at any time.

Business customers must be at least 18 years old and legally able to enter into a contract. You must provide accurate account information and keep your credentials secure — you are responsible for all activity under your account, including actions of your staff and agents. You must notify us promptly at support@benzos.uk of any unauthorised use or security incident affecting your account. We may suspend or terminate accounts that violate these Terms or pose a security, legal, or abuse risk.

In line with the EU AI Act (Regulation (EU) 2024/1689, Art. 50), End Users are informed that they are interacting with an AI system at the start of their first interaction with a bot, and the disclosure is shown whenever an AI (rather than a human agent) is handling the chat. End Users can request a transfer to a human agent at any time. Customers must not remove, hide, or obscure the AI disclosure, and must not configure a bot to impersonate a specific real person or impersonate a human in a way that would mislead End Users about the AI nature of the interaction.

As a Customer you are responsible for the content you upload, the knowledge base you train, and the way your bot is configured and used. You must have a lawful basis to process any personal data your bot collects, and you must comply with the GDPR and other applicable laws. You must not use the Service to: • send spam, unsolicited marketing, or phishing; • collect or process special-category personal data (e.g. health, biometric, political) without a lawful basis and appropriate safeguards; • provide regulated professional advice; • infringe intellectual-property, privacy, or other rights; • distribute malware, attempt to break tenant isolation, overload or reverse-engineer the Service; • mislead End Users about the identity, nature, or capabilities of the bot; • process data of children where prohibited by law. We may remove content and suspend accounts that violate this section.

Paid plans, usage limits, and prices are as shown on our site or in your order. Fees are payable in advance unless agreed otherwise and are exclusive of applicable taxes. AI usage may be metered (e.g. token cost); overage may be charged or throttled as described in your plan. Fees are non-refundable except where required by law. We may change prices on reasonable notice; continued use after the change takes effect is acceptance. Late or failed payment may lead to suspension of the Service.

As between the parties, you (the Customer) own your data and the content of your End Users' conversations. We process it as a processor on your instructions, in accordance with our Privacy Policy (https://chat.benzos.uk/policy) and the Data Processing Agreement that forms part of our agreement with business customers. End User personal data is handled as described in our Privacy Policy, including the international-transfer safeguards described there. We do not sell End User personal data, and we do not use End User messages to train external AI models without consent. We will assist you, as reasonably necessary and taking into account the nature of the processing, in responding to data-subject requests (access, erasure, portability) and in meeting your security, breach-notification, and DPIA obligations.

Benzos and its licensors own all rights in the Service, software, brand, and documentation. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service during your subscription, for your internal business purposes, subject to these Terms. You retain all rights to your own content and to your End Users' conversation data. You grant us the licence needed to host, process, and display that content solely to provide the Service.

The Service integrates with third-party platforms (Meta/Facebook Messenger, hosting, AI model providers, payment providers). Your use of those platforms is subject to their own terms. We are not responsible for third-party services, their availability, or their acts and omissions, though we choose providers carefully and put contracts and safeguards in place for personal-data transfers.

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted, error-free, or secure operation, nor the accuracy of AI-generated content. To the maximum extent permitted by law, Benzos is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the Service is limited to the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including liability for death or personal injury caused by negligence, or for fraud).

You may stop using the Service and close your account at any time. We may suspend or terminate your access for material breach of these Terms, non-payment, security or abuse risk, or where required by law. On termination, your right to use the Service ends. We will, on your request and subject to applicable law and retention obligations, make your data available for export for a reasonable period and then delete it, in line with our Privacy Policy. Provisions that by their nature should survive (IP, liability limits, governing law) will survive termination.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date; where changes are significant, we will give reasonable advance notice. Continued use after the effective date constitutes acceptance.

These Terms are governed by the laws applicable at the place of establishment of Benzos — Benzo Labs, without prejudice to mandatory consumer-protection rules in your country of residence.
